Dear Mr. Fässler,

Thank you for your letter of 13th December 2000.
The criteria agreed upon between the Council of Europe and the European
Commission provide that the European emblem can be used by third parties only if:

*there is no likelihood of the user of the emblem being confused with
the European Community or the Council of Europe;

*the emblem is not used in connection with objectives or activities
which are incompatible with the aims and principles of the European
Community or of the Council of Europe.

Authorization to use the European emblem implies no right of exclusive
use. It does not permit the appropriation of the emblem, or of any similar
trademark or logo, whether by registration or by any other means. There are no
specific provisions at Community level governing the use of the European flag.
In practical terms, this means that the European flag can be used within the
limits set by the national law governing flags.
